Come Bee Well House Participant Waiver
Waiver and Release of Liability
In connection with participating in any classes, sessions, workshops, retreats, events, vendor markets, or other services or activities offered by Come Bee Enterprises, LLC (“Come Bee”), including any use of Come Bee’s equipment, furnishings, facilities, products, goods, or digital content provided, purchased, or otherwise acquired from Come Bee, collectively referred to as “Come Bee Services & Goods,” I understand and agree, on behalf of myself, my minor children, if applicable, and our respective heirs and legal representatives, to the following:
Assumption of Risk
The study and practice of meditation, yoga, sound and vibration therapy, immersive chair/cushion experiences, and related wellness activities may involve inherent risks of injury and loss. Such injury or loss may include physical, mental, and/or emotional health issues.
Come Bee Services & Goods may also include optional enhancements such as aromatherapy, oils, balms, topicals, or other sensory products, as well as the sampling or consumption of drinks and food offered at the Well House (“Enhancements and Refreshments”). I understand that reactions, sensitivities, or adverse responses including skin irritation, allergic reactions, breakouts, or other physical discomfort may occur from the use or consumption of any Enhancements and Refreshments. I am solely responsible for determining whether any such products are appropriate for my personal use and for disclosing any allergies or sensitivities to Come Bee prior to participation. I voluntarily assume all risks associated with the use or consumption of any Enhancements and Refreshments.
Personal Responsibility
I understand that information shared by Come Bee is general in nature and may not apply to my specific needs. I am encouraged to consult a licensed physician or other health professional regarding my personal health conditions. I should never disregard, delay, or modify professional advice because of something I learned, heard, or was told while participating in Come Bee Services & Goods.
I am responsible at all times for personal property that I bring to Come Bee events or spaces. Come Bee is not responsible for lost, damaged, or stolen items.
Media Release
I hereby grant Come Bee permission to use my likeness, including photo, video, or audio, for promotional, educational, or community-building purposes, without compensation.
Disclaimer of Warranties and Assumption of Liability
Come Bee Services & Goods are offered on an “as is” and “as available” basis, without a warranty of any kind. To the maximum extent permitted by law, Come Bee disclaims all warranties, including implied warranties, regarding Come Bee Services & Goods and any premises where activities are held. Come Bee makes no representations, warranties, or guarantees that I will achieve any particular results, whether physical, mental, emotional, or otherwise.
To the maximum extent permitted by law, Come Bee and the Come Bee People are not liable for any allergic reactions, breakouts, sensitivities, or other adverse physical, mental, or emotional responses related to or arising from the use or consumption of any Enhancements and Refreshments, including but not limited to oils, balms, aromatherapy products, topicals, beverages, or food items provided at the Well House.
I voluntarily assume and accept all risks, known and unknown, whether caused by the negligence or gross negligence of Come Bee and/or its owners, managers, employees, vendors, guests, landlords, insurers, representatives, and agents, collectively referred to as the “Come Bee People.”
I voluntarily forever release, discharge, and waive any and all claims, causes of action, and other rights against Come Bee and the Come Bee People for any damages, liabilities, costs, expenses, or other amounts directly or indirectly arising out of or related to Come Bee Services & Goods and/or any premises used by Come Bee.
In no event shall Come Bee or the Come Bee People be liable for any direct, indirect, special, punitive, exemplary, or consequential damages or losses of any kind, whether based on breach of contract, tort, product liability, or other basis.
Indemnification
I agree to indemnify, defend, with legal counsel selected by Come Bee at my expense, and hold harmless Come Bee and the Come Bee People from and against any and all damages, liabilities, costs, expenses, and other amounts arising out of my participation in Come Bee Services & Goods and/or my breach of this Waiver and Release.
Minor Participants, If Applicable
If I am signing on behalf of my minor child or children, I acknowledge, understand, and agree that I am the parent or legal guardian of the minor(s), I consent to their participation in Come Bee Services & Goods, I understand and accept that participation involves inherent risks, and I voluntarily assume responsibility for all risks, known and unknown, on behalf of my minor child or children.
On behalf of myself, my minor child or children, and our heirs and legal representatives, I release, discharge, and waive all claims against Come Bee and the Come Bee People as set forth above. I grant Come Bee permission to use my minor child or children’s likeness, including photo, video, or audio, for promotional, educational, or community-building purposes, without compensation.
Miscellaneous
If any provision of this Waiver and Release is declared invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. No provision of this Waiver and Release can be waived without the prior written consent of an authorized representative of Come Bee.
This Waiver and Release is governed by the laws of the State of Texas.
Acknowledgment
I acknowledge that I have read and understood this Waiver and Release, and I voluntarily agree to its terms.
